  1. General Terms and Conditions

    1. Any and all information contained within this Internet Web Site (the Web Site and all of the following information herein shall be jointly referred to as “Site Content”), under the registered URL name ‘NewsHit.com.au’ (hereafter referred to as “News Hit”).

    2. The following terms and conditions apply regardless of the medium used to access any and all of the Site Content; are subject to amendment at News Hit’s discretion without notice; and are governed by, and interpreted in accordance with the laws of the State of Victoria and the Commonwealth of Australia.

    3. Craig Butt is the sole owner and operator of the Web Site ‘NewsHit.com.au’.

    4. By using any or all of the Site Content you agree to be bound by these Terms and Conditions. Use or access of any part of the Site Content indicates acceptance of these Terms and Conditions. In addition you agree not to use any of the Site Content for unlawful purposes.

    5. The Site Content has been prepared to provide entertainment only. It is not intended to constitute or be construed as providing substantive professional advice. Programming of the Site Content is not intended to create, nor does its reception create, a professional-client relationship between News Hit and any reader.

    6. All Site Content belongs to News Hit, its advertisers, or affiliates. In viewing the Site Content you obtain no claim to or rights to any of the intellectual property. Australian copyright and intellectual property laws protect all Site Content. You may not take any action that interferes with or breaches those laws, doing say may render you liable to legal action. Though News Hit may contain links or references to third party Web Sites and third-party content, please note that News Hit has no control over any content contained therein. The appearance of those links does not indicate News Hit’s endorsement of any content, products, services contained therein.

    7. All Site Content is available for personal, non-commercial use provided the Site Content is not modified in any way or form (including any copyright notice). News Hit reserves all rights not expressly granted under these terms of use. Unless otherwise stated no part of the Site Content may be reproduced or republished without the owner’s consent.

    8. The News Hit logo, brand, and Site Content are the intellectual property of News Hit. Other intellectual property may be displayed within the Site Content; these may belong to third parties and are protected by copyright and trademark laws. No Site Content should be construed as granting any claim or right to use or reproduce any logo, trademark, content, or banner, without the express written permission of the relevant owner.

    9. You agree to indemnify News Hit (including News Hit’s owners, staff, editors, contributors, and interns) for any and all legal costs affecting News Hit (including action, claim, loss, or expense) arising from your use of the Site Content.

  2. Disclaimers

    1. News Hit has taken every effort to ensure the accuracy and timeliness of the information published on the Site Content. News Hit does not take any responsibility for errors or omission of fact contained within any part of the Site Content.

    2. All articles, opinions, commentary, and media contained within the Site Content contain the opinions of our contributors and interns, and do not reflect the opinions of our editors, other News Hit staff, or News Hit’s owners. News Hit does endeavour to remain impartial and objective, all content published is intended to entertain only. Any and all content found to be inflammatory, offensive, or in anyway unlawful will be removed from the Site Content or amended where appropriate.

    7. News Hit may also link or reference third parties or third party content outside of content aggregation agreements. News Hit does not endorse any part of the Site Content linked or referenced with regard to third parties or third party content originating outside of content aggregation agreements. News Hit does not make any warranties or representations regarding the safety, suitability, or purpose of linked, referenced or republished Site Content for purpose, accuracy, or quality with regards to third parties and all third party content, responsibility for evaluation of third parties and all third party content is the sole responsibility of the user.

  3. Submission of Content to News Hit

    1. Any content submitted to News Hit is submitted on the understanding that submissions grant an exclusive, perpetual, royalty-free license to publish and republish that content. The right not to publish content contributed remains at the sole discretion of News Hit’s editors. When submitting any content you guarantee that you possess the necessary rights, including copyright, and that content submitted is neither defamatory nor infringes upon any Australian laws. When submitting content you agree to indemnify News Hit against any and all legal costs, damages, and expenses that may be incurred by News Hit as a result of any breaches of the above guarantee.

    2. Please note when submitting content that News Hit has in place several content aggregation agreements. The nature of these agreements requires News Hit and the other parties to the agreement to openly share all published content for republishing. When submitting content be aware that this content may be republished in third party publications, and in sharing this content News Hit is granting those publications perpetual, royalty-free licences to republish Site Content on those, and only those publications. If concerned where content may be republished, please contact Craig Butt (contact details available at end of this document) for a list of our affiliates.

    3. Use of the ‘commenting’ system at the footer of individual pieces of Site Content does not grant the user any rights or licenses with regard to Site Content. You agree, when commenting to offer fair, constructive commentary and will not use the ‘commenting’ system to proliferate spam, threaten, or make discriminatory, racial, sexual, or unlawful comments.

    1. Please be aware that News Hit may initiate legal action against breach of any of the above terms and conditions.

  5. Privacy Policy

    1. News Hit acknowledges the importance of all personally identifiable information obtained.

    2. News Hit is bound by State of Victorian and Commonwealth of Australia laws when collecting or using any personally identifiable information (hereafter information)

    3. News Hit obtains information when providing services. News Hit tries to ensure that users are informed as to why we are collecting information, when we collect it, and how we plan to use that information.

    4. News Hit usually collects information directly from you and from other sources, such as other companies and from public documents.

    5. News Hit will never disclose or misuse information without expressly written consent from the relevant owner.

    6. News Hit may collect certain non-personal information to optimise services including the Site Content for your computer (e.g., the identity of your Internet browser). We may use such non-personal information for internal purposes, including but not limited to improving the Site Content.

    7. News Hit endeavours to protect all information and has in place a variety of electronic and physical measures in place to prevent the misuse, unauthorised access, or disclosure of such information. At the same time News Hit wishes to convey that no electronic transmission can ever be totally secure.

    8. You have a right to access your personally identifiable information, you will be informed where News Hit lawfully denies you access in some circumstances. Requests for access can be forwarded to Craig Butt (contact details available at the end of this document).

    9. Information posted in public forums, message boards, and chat rooms becomes public information and News Hit has no control over how other users employ this information.

    10. Users should please note that when leaving the Site Content by way of third-party links or other navigational means, these third parties might collect and use information. News Hit wishes to advise these third parties are not subject to News Hit control or influence and may misuse information collected. News Hit is not in any way liable for third-party use of information. Users leaving the Site Content by way of third-party links should refer to the relevant third-party site policies before continuing.
